Deadlines for Economic and Property Damage Claims
You must file all of your claims for economic damages relating to the Deepwater Horizon Oil Spill before the close of the Settlement Program on April 22, 2014, or six months after the effective date of the settlement, whichever is later. The effective date of the settlement is the date that the Court grants final approval to the economic settlement and all appeals to that final order are resolved. Once the claim filing deadlines are finalized, they will be made available to the public.
If you file multiple claims regarding economic damages that you or your business sustained in the Deepwater Horizon Oil Spill, you must file all of your claims within six months of the date that you receive your first settlement payment. The one exception to this rule is if you are filing a claim in the Seafood Compensation Program. Those claims must be filed within 30 days of the Court’s final approval of the settlement, regardless of any appeals that might occur. Although the Final Order and Judgment has not yet been issued, it will not occur, in any event, prior to the Fairness Hearing, which is currently scheduled for November 8, 2012.
If you fail to meet the claim deadlines set forth above, you will lose your opportunity to seek compensation under the Settlement.
Deadlines for Medical Benefits Claims
The deadline for filing a claim for medical benefits for injuries or illnesses that you have suffered as a result of the Deepwater Horizon Oil Spill is one year after the Medical Benefits Settlement becomes effective, or after the Court grants final approval of the Settlement and all resulting appeals are resolved. Since final approval has not yet been granted by the Court, the exact medical benefits claims deadline has not been established but will be made available to the public as soon as the Court grants final approval of the Settlement.
If you fail to file a medical benefits claim prior to the deadline, you will lose your opportunity to obtain any medical benefits from the Settlement, including compensation for a Specified Physical Condition and/or the opportunity to participate in the Periodic Medical Consultation Program.
